Uponor, Inc. and several home builders, plumbers and distributor partners have requested court approval of two class-action settlements relating to alleged failure risks of Uponor yellow brass fittings.
“We continue to have a high level of confidence in the long-term performance of these products as they have an excellent track record, but view these settlements as a way to resolve extensive litigation and assure our customers and partners that we stand behind our products,” said Bill Gray, president of Uponor, Inc.
In July of 2008, several Las Vegas homeowners filed a class action lawsuit against Uponor and other defendants, alleging the company manufactured defective yellow brass fittings. A Nevada federal judge dismissed the majority of the claims in 2013, but allowed the plaintiffs to revise the complaint.
According to the terms of the settlements, Uponor, Inc. will be providing an enhanced warranty to property owners to cover potential fitting failures. There also will be a separate claims fund established to honor the terms of an enhanced warranty. Details of the Settlements are subject to final Court approval.
